Gender Identity Final Rule Ensures Equal Access to Homeless Programs for All

 

The U.S. Department of Housing and Urban Development (HUD) final rule Equal Access in Accordance with an Individual’s Gender Identity in Community Planning and Development Programs requires housing providers, funded by HUD’s Office of Community Planning and Development to provide full access to programs, services, and accommodations to individuals’ based on their gender identity. This final rule amends the 2012 Equal Access to Housing in HUD Programs Regardless of Sexual Orientation or Gender Identity, by addressing the unique needs of admission and accommodation of shelters for transgender and non-gender confirming individuals. It clarifies the definition of “gender identity” that better describe the difference between actual and perceived gender identity and removes unnecessary questions regarding sexual orientation for admission to housing programs.
