HUD Seeks Comment on Gender Identity Rule Source

On November 20, the U.S. Department of Housing and Urban Development released a proposed federal rule, entitled Equal Access in Accordance with an Individual’s Gender Identity in Community Planning and Development Programs Rule,also referred to as the Gender Identity Rule. This rule was drafted after careful revision of the Equal Access to Housing in HUD Programs Regardless of Sexual Orientation or Gender Identity Rule, which establishes that HUD-assisted housing programs are available to all individuals and families regardless of sexual orientation, gender identity, or material status in community planning and development programs.

The proposed rule seeks to revise the current definition of gender identity, remove the rule about inquiries of individuals’ sexual orientation or gender identity for housing programs, and provide equal access to all of HUD’s community development programs.
